Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TerraLog iOS application and companion website (together, the "Service"), operated by TerraLog ("TerraLog," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

TerraLog lets you post short, location-tagged messages that appear on a shareable map, and request weather and avalanche forecasts, over satellite and cellular SMS, designed for use off-grid where traditional data service may not be available. The Service is currently available only to users located in the United States.

2. Accounts and SMS

You must provide an accurate phone number to create an account. You are responsible for keeping your phone number and device secure, and for all activity that occurs through your account.

SMS consent. By continuing, you consent to receive SMS messages from TerraLog in order to confirm that messages you've sent were successfully posted. Message and data rates may apply. You can opt out of receiving these messages at any time by replying "STOP" to any SMS message or by contacting [email protected].

3. Passes, Free Trial, and Billing

TerraLog is usage-based: instead of a recurring subscription, you purchase time-limited "passes" that grant full access to the Service:

  • Day pass: $3
  • Week pass: $5
  • Month pass: $10

New accounts start with a 14-day free trial. After your trial ends, a pass is automatically activated and your card on file is automatically charged only when you actually use the Service (for example, posting a message or requesting a forecast); you are not charged for periods in which you don't use TerraLog. Continued use after a pass expires will trigger a new pass purchase and charge under the same automatic, usage-based model. You authorize us and our payment processor to charge your payment method on this basis.

All card payments are processed by Stripe through Stripe Checkout, a hosted payment page operated by Stripe. TerraLog does not receive or store your full card number. Your payment is also subject to Stripe's own terms. Passes are consumed as described above and, except as required by law, are non-refundable once a pass has been activated and used.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • Post content that is harassing, threatening, defamatory, obscene, or that violates the rights of others;
  • Post location or content intended to mislead others about your whereabouts or safety in a way that could endanger yourself or others;
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Service, its infrastructure, or other users' accounts;
  • Use the Service to send spam or unsolicited messages, or to abuse SMS delivery in a way that harms our carriers or service providers; or
  • Reverse engineer, resell, or misuse the Service outside of its intended, personal use.

We may suspend or terminate accounts that violate these rules.

5. Safety Disclaimer: Weather and Avalanche Forecasts

Weather and avalanche forecasts provided through TerraLog are sourced from third-party providers and are provided for general informational purposes only. They are not a substitute for professional avalanche training, official avalanche center bulletins, or your own on-the-ground judgment. Backcountry travel, including in avalanche terrain, carries inherent risk of serious injury or death. You are solely responsible for evaluating conditions, obtaining appropriate training and equipment, and deciding whether and how to travel in any given area. Do not rely on TerraLog as your only source of safety information.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR AVAILABLE AT ALL TIMES OR LOCATIONS (INCLUDING BECAUSE SATELLITE OR CELLULAR CONNECTIVITY MAY BE UNAVAILABLE OR DELAYED). YOU USE THE SERVICE, INCLUDING WHEN TRAVELING OFF-GRID OR IN REMOTE OR HAZARDOUS TERRAIN, AT YOUR OWN RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TERRALOG AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING RELIANCE ON ANY WEATHER OR AVALANCHE FORECAST, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO TERRALOG IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

8. Termination

You may stop using the Service and delete your account at any time from the app (Settings) or the web dashboard, which removes your posts, passes, and account record as described in our Privacy Policy. We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, or if we discontinue the Service, with notice where reasonably practicable. Sections that by their nature should survive termination (including Sections 5, 6, 7, and 9) will survive.

9. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Washington, and you consent to personal jurisdiction there.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in the app or by SMS. Continued use of the Service after a change becomes effective means you accept the revised Terms.
